Annexure A

Restrictions on the usage of the Services and the ONDC Network

  1. You shall not and shall not permit any third party to engage in any activity or conduct any transaction in the Services or on the ONDC Network that is illegal, unlawful, fraudulent or for which you do not have necessary permissions or licenses from the requisite competent authority.
  2. You shall not engage in any transmission of information prohibited under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 as may be amended from time to time or any other applicable law. Similarly, you must not host, display, upload, modify, publish, transmit, or share any content which:
    1. belongs to another person and over which you have no right;
    2. is grossly harmful, obscene, pornographic, pedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, blasphemous, defamatory, bigotry, libellous, hateful, racially or ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, [or an online game that causes user harm,] or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence, or otherwise unlawful in any manner whatever, or unlawfully threatening or harassing, including but not limited to ‘indecent representation of women’ within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
    3. is false, inaccurate or misleading in any way;
    4. is patently offensive to the online community, such as sexually explicit content or content that promotes obscenity, pedophilia, racism, bigotry, hatred, or physical harm of any kind against any group or individual;
    5. deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is false and untrue or misleading in nature [or, in respect of any services of the Central Government, is identified as fake or false or misleading by such fact check unit of the Central Government as the Ministry may, by notification published in the Official Gazette, specify];
    6. harasses or advocates harassment of another person;
    7. impersonates another person;
    8. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting other nation;
    9. contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
    10. involves the transmission of ‘junk mail’, ‘chain letters’, unsolicited mass mailing, or ‘spamming’; including spamming by ways of unrelated feedbacks on surveys;
    11. promotes illegal activity or conduct that is abusive, threatening, defamatory, or libellous;
    12. is aimed at exploiting people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
    13. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, providing or creating computer viruses;
    14. contains unauthorised videos, photographs or images of another person (whether a minor or an adult);
    15. harms minors in any way;
    16. infringes any patent, trademark, copyright, proprietary rights, third-party’s trade secrets, rights of publicity, or privacy, is fraudulent, or involves the sale of counterfeit or stolen items;
  3. You must not offer or sell Products that,
    1. does not work perfectly in every regard;
    2. is not clean, shows signs of mold, heavy staining, or corrosion;
    3. is damaged in a way that renders it difficult to use;
    4. is missing essential accompanying material or parts.
    5. requires repair or service.
    6. was not created by the original manufacturer or copyright holder. This includes copies, counterfeits, replicas and imitations.
    7. was originally distributed as a promotional copy, promotional bundle, product sample, or advance reading copy. This includes uncorrected proofs of in-print or not-yet-published books.
    8. is obscured and not able to be read or viewed because of markings, stickers, or other damage in any aspect.
    9. has passed the expiration date (includes "best by" and "sell by" dates), has an unacceptably short shelf life remaining, or has had the expiration date removed or tampered with.
    10. was intended for destruction or disposal or otherwise designated as unsaleable by the manufacturer or a supplier, vendor, or retailer.
    11. is prohibited for sale on the ONDC Network.
  4. List of activities and Products (including services) that are prohibited to be offered or provided through the Services include,
    1. Adult goods and services which include pornography and other sexually suggestive materials (including literature, imagery and other media); escort or prostitution services; website access and/or website memberships of pornography or illegal sites.
    2. Child pornography which includes pornographic materials involving minors.
    3. Bulk marketing tools which include email lists, software, or other products enabling unsolicited email messages (spam).
    4. Database that includes personal information in any form.
    5. Mailing lists.
    6. Copyright unlocking devices which include mod chips or other devices designed to circumvent copyright protection.
    7. Copyrighted media which includes unauthorized copies of books, music, movies, and other licensed or protected materials; Copyrighted software which includes unauthorized copies of software, video games and other licensed or protected materials, including OEM or bundled software.
    8. Hacking and cracking materials which includes manuals, how-to guides, information, or equipment enabling illegal access to software, servers, website, or other protected property.
    9. Counterfeit and unauthorized goods which include replicas or imitations of designer goods; items without a celebrity endorsement that would normally require such an association; fake autographs, counterfeit stamps, and other potentially unauthorized goods.
    10. Gambling which includes lottery tickets, sports bets, memberships/ enrolment in online gambling sites, and related content. Skill based games may be allowed on a case to case basis.
    11. Money laundering services;
    12. Uncrossed (bearer) drafts / cheques, currency and coins
    13. Virtual currency, cryptocurrency, prohibited investments for commercial gain or credits that can be monetized, re-sold or converted to physical or digital goods or services or otherwise exit the virtual world.
    14. Wholesale currency which includes discounted currencies or currency exchanges.
    15. Securities which include government bonds or related financial products.
    16. Government IDs or documents which include fake IDs, passports, diplomas, and noble titles
    17. Alcohol which includes alcohol or alcoholic beverages such as beer, liquor, wine, or champagne.
    18. Drugs and drug paraphernalia which include illegal drugs and drug accessories, including herbal drugs like salvia and magic mushrooms.
    19. Drug test circumvention aids which includes drug cleansing shakes, urine test additives, and related items.
    20. Miracle cures which include unsubstantiated cures, remedies or other items marketed as quick health fixes.
    21. Tobacco and cigarettes which include cigarettes, cigars, chewing tobacco, and related products.
    22. Narcotic Substances
    23. Machinery (chain saws, outboard engines containing fuel or that have contained fuel)
    24. Fuel for camp stoves, lanterns, torches or heating elements Automobile batteries Infectious substances
    25. Any compound, liquid or gas that has toxic characteristics Bleach
    26. Dry ice (Carbon Dioxide, Solid) Pressurised Containers
    27. Magnetised materials
    28. Pyrotechnic devices, combustibles, corrosives and hazardous materials which include explosives and related goods; toxic, flammable, and radioactive materials and substances.
    29. Weapons which include firearms, ammunition, explosives, military equipment, flammable adhesives arms, knives, brass knuckles, gun parts, and other armaments.
    30. Regulated goods which include air bags; lithium batteries; batteries containing mercury; freon or similar substances/refrigerants; chemical/industrial solvents; insecticides; pesticides; garden chemicals; fertilizers; poisons; oil based paint and thinners (flammable liquids); hazardous chemical items; government uniforms; car titles; license plates; police badges and law enforcement equipment; lock-picking devices; postage meters; recalled items; slot machines; surveillance equipment; goods regulated by government or other agency specifications.
    31. Cable descramblers and black boxes which include devices intended to obtain cable and satellite signals for free.
    32. Traffic devices which include radar detectors/jammers, license plate covers, traffic signal changers, and related products.
    33. Illegal goods which include materials, products, or information promoting illegal goods or enabling illegal acts.
    34. Offensive goods which include literature, products or other materials that:
      1. Defame or slander any person or groups of people based on race, ethnicity, national origin, religion, sex, or other factors;
      2. Encourage or incite violent acts; or
      3. Promote intolerance or hatred.
    35. Offensive goods related to crime, which include crime scene photos or items such as personal belongings associated with criminals.
    36. Endangered species which include plants, animals or other organisms (including product derivatives) in danger of extinction.
    37. Live animals or hides/skins/teeth, nails and other parts etc. of animals.
    38. Matrix sites or sites using a matrix scheme approach.
    39. Drop-shipped merchandise.
    40. Bidding/auction services
    41. Businesses or website that operate within the scope of laws which are not absolutely clear or are ambiguous in nature (e.g. web-based telephony, website supplying medicines or controlled substances, website that promise online match-making).
    42. Businesses out rightly banned by law (e.g., betting and gambling, publications or content that authorities may interpret as promoting moral turpitude or decadence, inciting caste or communal tensions, lotteries, sweepstakes, and games of chance).
    43. Dealing in intangible goods/ services (eg. software download/ health/ beauty Products), involvement in pyramid marketing schemes or get-rich-quick schemes.
    44. Streaming and Live streaming (incl. video, music, gaming)
    45. Activities prohibited by the Telecom Regulatory Authority of India.
    46. Any other product or service that, in the sole opinion of ONDC, is considered to be a prohibited goods/services as communicated to the seller from time to time.
    47. Any other activities prohibited by or not in compliance with applicable laws and regulations, whether federal, state, local, or international, including the laws of India.
